These Terms of Service (“Terms”) govern your access to and use of the Sendinel platform (“Service”), operated by Desler Digital Enterprises LLC(“we,” “us,” “our”), a Hawaii limited liability company. By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
You must be at least 16 years old and capable of forming a binding contract to use Sendinel. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
You agree not to use Sendinel to:
We reserve the right to suspend or terminate accounts that violate these rules, with or without notice.
You are solely responsible for the content of emails you send through Sendinel and for maintaining valid consent from your recipients. You must include a functioning unsubscribe mechanism in all marketing emails. We may suspend sending privileges if we detect abuse, high bounce rates, or spam complaints that threaten our sending reputation or the reputation of other users.
You retain ownership of all content and data you upload to Sendinel (“Your Data”). You grant us a limited license to process Your Data solely to provide the Service. We will not access, use, or share Your Data except as described in our Privacy Policy or as required by law.
Sendinel uses artificial intelligence to generate email content, subject lines, and segment recommendations. AI-generated content is provided as suggestions. You are responsible for reviewing and approving all content before it is sent. We do not guarantee the accuracy, appropriateness, or effectiveness of AI-generated content.
The Sendinel name, logo, software, and documentation are the property of Desler Digital Enterprises LLC. These Terms do not grant you any right to use our trademarks or branding. You retain all rights to Your Data and any email content you create.
We strive to maintain high availability but do not guarantee uninterrupted access. We may perform scheduled maintenance with reasonable advance notice. We are not liable for downtime caused by factors beyond our reasonable control, including third-party service outages, natural disasters, or network failures.
To the maximum extent permitted by law, Desler Digital Enterprises LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, whether incurred directly or indirectly, arising from your use of the Service. Our total aggregate liability for any claims arising from these Terms or the Service shall not exceed the amount you paid us in the 12 months preceding the claim.
The Service is provided “as is” and “as available” without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
Either party may terminate this agreement at any time. You may delete your account from the dashboard settings. We may suspend or terminate your access if you violate these Terms. Upon termination, your right to use the Service ceases immediately. We will retain Your Data for 30 days after termination, after which it will be permanently deleted.
These Terms are governed by the laws of the State of Hawaii, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved in the state or federal courts located in Honolulu County, Hawaii.
We may modify these Terms at any time. We will notify you of material changes by posting the revised Terms on this page with an updated effective date. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
